ACCEPTABLE USE POLICY
Barefoot Technologies Corporation (“Barefoot”) is at all times committed to complying with the laws and regulations governing use of the Internet, e-mail transmission and text messaging and preserving for all of its users (each individually or together the “you,” “yours”) the ability to access and use Barefoot’s Site, software, and products (the “Services”) without interference or harassment from other users. This Barefoot Acceptable Use Policy (the "AUP") is designed to help achieve these goals.
ACCEPTANCE
By accessing using the Services, you agree and acknowledge that your access to and use of the Services is conditioned upon your compliance with this AUP and that you are responsible for ensuring that your Users meet the standards set forth herein. Barefoot reserves the right to change or modify the terms of the AUP at any time, effective when posted on Barefoot’s web site at www.barefoot.com. Your use of the Service(s) after changes to this AUP are posted shall constitute acceptance of any changed or additional terms.
VIOLATIONS OF THE AUP
If, in Barefoot’s sole and absolute discretion, any Material (as defined below) is provided to or through the Services, that is unlawful, indecent, objectionable or otherwise violates this AUP, Barefoot reserves the right, without notice, to: (i) remove any violative content; and/or (ii) suspend and/or terminate the violating party’s access to the Services. For purposes of this policy, “Material” refers to all forms of communications including narrative descriptions, graphics (including photographs, illustrations, images, drawings, and logos), executable programs, video recordings, and audio recordings. Barefoot may cooperate with legal authorities and/or other such third parties in the investigation of any suspected or alleged crime or civil wrongdoing.
PROHIBITED ACTIVITIES
Activities that constitute a violation of this AUP, and are thus prohibited, include without limitation:
Illegal use. You may not use the Services for or in support of any illegal purpose or activity in violation of any applicable local, state, provincial, federal, national or international law, treaty, court order, ordinance, regulation or administrative rule.
Harm to minors. You may not use the Services to harm, or attempt to harm, minors in any way, including, but not limited to the publication, submission, reception, upload, download, post, use, copy or production, transmission, distribution or storage of child pornography.
Threats. You may not use the Services to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.
Harassment. You may not use the Services to transmit any material (by e-mail, uploading, posting or otherwise) that harasses, or threatens the health or safety of, another.
Fraudulent activity. You may not use the Services to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as pyramid schemes, ponzi-schemes, and chain letters.
Forgery or impersonation. You may not use the Services to add, remove or modify identifying network header information in an effort to deceive or mislead. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
SPAM/E-mail/Usenet Abuse. Violation of the CAN-SPAM Act of 2003, or any other applicable law regulating e-mail services, constitutes a violation of this AUP.
Unsolicited/Bulk E-mail. You may not use the Services to transmit any unsolicited commercial or unsolicited bulk e-mail.
E-mail / news bombing. Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending Barefoot account.
E-mail / message forging. You may not forge any message header, in part or whole, of any electronic transmission, originating or passing through the Service.
Usenet spamming. You may not use the Services for the posting of messages or commercial advertisements, which violate the rules, regulations, or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.
Unauthorized access. You may not use the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, Barefoot’s security measures or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data. You will not attempt to obtain another user’s account password. Sharing passwords and account access with unauthorized users is prohibited. It is Your sole responsibility to keep any password(s) secure.
Copyright or trademark infringement. You may not use the Services to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
Collection of personal data. You may not use the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
IRC. Use of IRC or IRC bots or clonebots is not allowed. An IRC bot is a program which runs and is connected to an IRC server twenty-four (24) hours a day, automatically performing certain actions
Network disruptions and unfriendly activity. Use of the Service for any activity which affects the ability of other people or systems or the Internet. This includes “denial of service” (DOS) attacks against another network host or individual user.
Distribution of viruses. You may not use the Services to intentionally distribute software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited.
Third party accountability. You will be held responsible and accountable for any activity by third parties, using its account that violates guidelines created within the AUP.
SECURITY
You are responsible for ensuring and maintaining security of their systems and the machines that connect to and use the Services, including implementation of necessary patches and operating system updates.
The Services may not be used to interfere with, gain unauthorized access to, or otherwise violate the security of Barefoot’s (or another party's) server, network, network access, personal computer or control devices, software or data, or other system, or to attempt to do any of the foregoing.
YOUR RESPONSIBILITIES
You remain solely and fully responsible for the content of any material posted, hosted, downloaded/uploaded, created, accessed or transmitted using the Services. Barefoot has no responsibility for any material created by you, including content provided on any third-party websites linked to the Services. Such third-party website links are provided as Internet navigation tools for informational purposes only, and do not constitute in any way an endorsement by Barefoot of the content(s) of such sites.
You are responsible for taking prompt corrective action(s) to remedy a violation of the AUP and to help prevent similar future violations.
INCIDENT REPORTING
Any complaints (other than claims of copyright or trademark infringement) regarding violation of this AUP should be directed to support@barefoot.com. Where possible, include details that would assist barefoot in investigating and resolving such complaint (e.g. expanded headers, IP address(s), a copy of the offending transmission and any log files).
